Homecomings Financial has basically ran a "trick play" with my mortgage. I was amazed to find out that I am not the only one they've done this to.

It started back in August of 2007, when I recieved an enormous mtg bill of 3000.00. When I called to find out why, They told me that they had escrowed my mtg, eventhoug I was paying my own taxes and insurance. My taxes were 4200.00 but they charged my mtg over 11,000.00 dollars. At this point I wasnt sure what happened so I began to try and negotiate with them to no avail.

I asked about any solutions that were avaliable, loss mitigation, loan modification and any other hardship programs they might have. All of my efforts were a waist of time.

I tried to refinance with another mtg company, but the had changed my mtg from a 7.5% fixed 30year to a 8.9% adjustable with a 15,000. pre payment penalty. This made me unrefinancable. I also asked if I refinance with you would you wav the prepayment penalty? The answer was a resounding no! So at this time my house has gone into foreclosure because of their tactics.

They purchased my mtg from Lennox Finicial @7.5% 30year fixed rat with no prepayment penalty and I have the loan app to prove it. Yet they still will not budge.

I asked them to fax me the contract they purchased from Lennox Financial, after reviewing it I realized that I had never seen that contract before, eventhoug it had my initials on it. I'll tell you it was really fishy so I contacted a lawyer. All that being said after finding out about this class action lawsuit I realize that this more than a simple mistake. Its deliberiate.
